STATE OF COLORADO
DIVISION OF MINERALS AND GEOLOGY
Department of Natural Resources
1373 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303} 8664567
FAX: (303) 832-8106
DATE: July 29, 2003
TO: Gregg Squire /~
FROM: Allen Sorenson /~f
RE: Adequacy Review - Floodplain Impacts, Mountain Aggregates,
Empire Pit, Permit No. M-1977-534
~~
)LORADO
VISION O F
INERALS
EOI,OGY
LANATION•NINING
iAf ETY•SCIENCE
Bill Owens
Governor
Greg E. Walther
Executive DlreC[Or
Ronald W. Cattany
Division Director
Natual Resource Trustee
Amendment AM-Ol to the Empire Pit permit describes a levee that will be constructed along the right
bank of the West Fork of Cleaz Creek. The levee will prevent the probable maximum flood from
spilling into the proposed reservoir. The levee will also serve to raise water surface elevations and
increase the size of azeas inundated during extreme flooding through the Town of Empire and other
downstream property. If the areas south of the.proposed levee aze not in the jurisdictional floodpiain
(100-year floodplain), then construction of the proposed levee may proceed without having to address
the potential for increased downstream flooding that may be caused by the levee. If the areas south of
the proposed levee aze currently in the jurisdictional floodplain, then the Applicant should have an
approval from the local floodplain authority to construct the levee. The Division of Minerals and
Geology (DMG) does not want to duplicate the regulatory activities of other jurisdictions, but the
Applicant must provide DMG with a description of the how the floodplain issues relative to the
proposed levee and reservoir have been analyzed and addressed from both the technical and regulatory
standpoints.
cc: Cazl Mount, DMG (via email)
c:~acs~Ivly Documents~clnpire pit Oood memo.doc
Office of Office of ~ Colorado
Mined land Reclamation ~ Active and Inactive Mines Geological Surva
