Cattany <br />Division DIreCID1 <br />Natural Resource Trustee <br />The Division of Minerals and Geology has received your application for the "Empire Pit" Amendment. <br />Listed below aze the Division's adequacy review comments for this application. The Division is <br />required to make a decision no later than September 11, 2003, therefore, your response to the <br />following adequacy review concerns should be received by the Division by August 15, 2003 to allow <br />an adequate time to review your responses. <br />Map Exhibit C-1: Pre-Mine Plan Map shows property owner No. 5 -Bruce E. and Catherine <br />Russell as owning property just west of the extreme westerly portion of the proposed permit <br />boundary, but does not indicate on the map the north/south trending boundary of their property <br />in relation to the proposed permit boundary. Please submit a revised map which depicts the <br />appropriate property boundaries. <br />2. Exhibit E -Reclamation Plan: The applicant is proposing to construct a levee to prevent <br />flooding from CIeaz Creek from spilling into the proposed reservoir. Division stafl'has <br />expressed some concems regazding the potential impacts of the levee on the floodplain of the <br />stream. Please review the enclosed memo of 7-29-03 from Allen Sorenson " Floodplain <br />Impacts, Mountain Aggregates, Empire Pit" and respond to these concerns. <br />The Division received a comment letter from the Jefferson Conservation District commenting <br />on the proposed seed mix. This letter was faxed to your consultant, Banks And Gesso. The <br />letter recommended that crested wheatgrass be avoided. One option would be to substitute <br />western wheatgrass. The District also discouraged the use of Canada bluegrass and suggested <br />several other native species, as well as the non-native sheep fescue.
