The U.S. Department of Energy Grand Junction Office <br />(DOE-GJO), in conjunction with the U.S. Bureau of Land Management, Uncompahgre Field <br />Office, examined the C-LP-21 Mine site and determined that Cotter Corporation's reclamation <br />efforts were completed in accordance with applicable environmental requirements and lease <br />stipulations, with the exception of the reestablishment ofadequate vegetation. Pursuant to that <br />determination, DOE-GJO is requiring Cotter Corporation to continue its reclamation <br />performance bonding with DOE in the amount of $5,000 until adequate vegetation is <br />reestablished at the site (expected to take at least two more growing seasons). <br />Accordingly, DOE-GJO has no objection to the Colorado Division of Minerals and Geology <br />granting Cotter Corporation's request for release (all or portion) of the subject permit. <br />If you have any questions concerning this matter, please contact me at (970) 248-6004. <br />Sincerely, <br />Michael K.
