STATE OF COLORADO
Bill Owens, Governor
DEPARTMENT OF NATURAL RESOURCES
DIVISION OF WILDLIFE
AN EQUAL OPPORTUNITY EMPLOYER
Bruce McCloskey, Acting Director
6060 Broadway
Denver, Colorado 80216
Telephone: (303) 297-1192
June 2, 2004
Joe Gagliano
LJ Development, INC.
159 Tiffany CT.
Pueblo, CO 81005
Dear Mr. Gagliano:
RECEIV EID
~UL ~ ~
Division of Minerals and Geology
For ~~ellife-
ForPeople
The Colorado Division of Wildlife (CDOW) has reviewed your conversion application from a 110c
Permit to a 112c MLRB Permit for the ULA PIT in Custer County, Colorado. This privately owned
sand, gravel, and construction aggregate mine is located west of the town of Westcliffe on Hermit Road.
The property described as the SW '/< SW '/< Section 16, Township 22 South, Range 73 West of the 8`n
Principle Meridian lies within an area providing valuable wildlife habitat.
It lies within the overall range for pronghorn antelope, elk, and mule deer. In addition, many small game
species utilize this rangeland area. Its close proximity to National Forest lands and the fact it is
surrounded by large ranches also increases its value to the wildlife resource. Our CDOW representative
in Custer County has observed pronghorn antelope using this area routinely and during a recent site
inspection noted several pronghorn antelope using this property.
Our CDOW representative observed a very low frequency of noxious weeds on the property. It is
primarily dominated by rangeland grasses and surrounding areas are also relatively weed-free. This will
be something to monitor not just during the reclamation period but also during regular excavation
activities. This is addressed in the reclamation..planundev 3.1.10 (6).
If the permit conversion request is granted, the CDOW requests the following:
• CDOW has reviewed the reclamation plan and requests that the plan be followed during
reclamation of the property.
• If possible, new excavation activities should be kept to a minimum during the spring months
(May, June) when pronghorn antelope and mule deer aze fawning.
• Weeds should be monitored during all phases of excavation and reclamation. All equipment
should be cleaned thoroughly before working in the azea.
• Any weed invasion shall be immediately reported and eradicated. Leafy Spurge in particular, is a
noxious weed of concern in Custer County.
DEPARTMENT OF NATURAL RESOURCES, Russell George, Executive Director
WILDLIFE COMMISSION, Philip James, Chair.
