RECEIVED %ESA CO CLERK 8 RECOkDER 08/31/01 1110An LEGAL RIGHT TO ENTER AGREEMENT THIS AGREEMENT is made and entered into this,~~ day of August, 2001 by and between Gary Rindede, the individual property owner, and Gary Rindede Construction, Inc., a Colorado Corporation, hereinafter referred to as "Rindede Construction'. WHEREAS, Gary Rindede curtently owns property located in the SW 1/4 SW 1/4 of Section t7, Township 1 South, Range 2 East, of the Ute Meridian, Mesa, County, Colorado. WHEREAS, Rindede Construction is in the process of obtaining a mining permit from the Colorado Division of Minerals and Geology for the purpose of mining, processing and removing sand and gravel (construction and landscape materials) upon the propeRy owned by Gary Rinderte. Such mining activity is known and referted to as UPLAND GRAVEL. WHEREAS, the Colorado Division of Minerals and Geology has requested an agreement from Gary Rindede for Rindede Construction to enter upon the said property and conduct said mining activities. NOW THEREFORE, Rindede Construction, its agents, employees or assigns, is hereby granted full access and authority to conduct such mining activities authorized by said mining permit. Rinderte Construction shall conduct such activities in a safe and prudent mannerand shall comply with applicable rules and regulations promulgated by federal, state and county agencies, including, but not limited to reclamation obligations relating its mining operations.
