Commencing at the S-1/4 comer of Section 17, Township 1 South, Range 2 East, Ute <br />Meridian, hence N 79°27'50" E. 3.54 feet to the point of diversion located in the SW-1/4 SE-1/4 of <br />Section l7, Township 1 South, Range 2 East, Ute Meridian. <br />8. The date of appropriation is December 30, 1999 <br />The Referee does, therefore, conclude that the Application should be granted and orders that <br />6 cubic feet of water per second be hereby awarded the Rinderle Diversion Ditch, conditional, for <br />irrigation of 220 acres, stock water, and wildlife purposes. <br />Should the owner of those conditional water rights intend to maintain them hereafter, an <br />application for a fmding ufreasonablediligence and/orto make the conditional waterrights absolute <br />shall be filed in the month and year set forth in the Decree below, except that this Court may <br />determine, prior to that date, that such conditional rights have been made absolute by the completion <br />of the appropriation. <br />The owner of those conditional water rights shall comply with Rule 9 of the Uniform <br />Local Rules for all State Water Divisions, as follows: (a) Upon the sale or other transfer of any <br />conditional water right, the transferee shall file with this Water Court a notice of transfer <br />which shall state: the title and case number of the casein which the conditional decree was <br />issued; the description of the conditional water right transferred; the name of the transferor; <br />the name and mailing address of the transferee; and a copy of the recorded deed. (b) The <br />owner of any conditional water right shall notify the Clerk of the Water Court having <br />jurisdiction of any change in mailing address. That Water Clerk shall place any notice oftransfer <br />or change of address in the case file in which the conditional decree was entered and in the case file <br />in which the Court first made a finding of reasonable diligence. <br />It is further QRDERED that this Ruling shall be filed with the Water Clerk, subject to <br />judicial review. <br />It i s further ORDERED that a copy of this Ruling shall be filed with the appropriate Division <br />Engineer and the State Engineer. <br />Dated: _, 2001. <br />Water Referee <br />Co of the fore oin mai ed <br />to all Counsel ofrecord / <br />Wate efcre jv.
