It was not the intent of Chaffee County to become an objector or <br />a party to the application. <br />Chaffee County's intent was to inform both the applicant and DMG that the County's land use <br />regulations require compliance prior to commencement of mining, and that any mining in excess <br />of that originally permitted in 1987 would be considered a zoning violation, subject to the <br />penalties discussed in the Chaffee County Zoning Resolution. <br />We understand it is not the role of the Division of Minerals and Geology to ensure local land use <br />regulations are complied with, and that it is the applicant's responsibility to guarantee <br />compliance with local land use and all other applicable regulations. <br />With the above in mind, Chaffee County wishes to withdraw its status as an objector to this <br />application, as it was not our intent to be an official party to the application.
