the grounds that the Petitioner failed to meet the performance standard for vegetative <br />cover. <br />3. The Division of State Parks ("State Pazks") agreed to assume the reclamation obligation <br />for the property. Prior to assuming that responsibility, State Parks met with the Petitioner <br />on the site and requested the completion of additional reclamation measures before <br />requesting a new release of the property. <br />4. All of those reclamation measures were complete except one, which required the seeding of <br />a topsoil stockpile to provide stabilization of the stockpile. <br />The Petitioner again requested a release and the Division again denied Petitioner's request <br />on the grounds that the site had not been properly revegetated. The Petitioner then requested <br />this appeal of the Division's decision. <br />6. The Division has concluded that it has no further objection to the partial release of <br />Petitioner's property from Petitioner's reclamation obligation. <br />Because State Parks has agreed to assume the reclamation obligation for this property, <br />because the majority of suggested reclamation measures have been completed, and because <br />the Division no longer objects to the requested release, it is appropriate to grant Petitioner's <br />request for a release of the 104.67-acre parcel from the Petitioner's reclamation obligation. <br />
