Box 15596 <br />Lakewood, Colorado 80215 <br />RE: Minor Revision No. 7 - Leach Field Construction <br />New Elk Mine - File No. C-012-81 <br />Dear Mr. Stout: <br />• Enclosed is the approval for the above-referenced minor revision. The <br />Division has found that although the leach field will extend to within <br />100 feet of the Purgatoire River, that: 1) the area has been previously <br />disturbed by mining activity; 2) the stream channel will not be affected by <br />the revision; 3) if approved by the Colorado Department of Health, water <br />quality and quantity will not be adversly affected; and, 4) the reclamation <br />plan calls for the establishment of appropriate vegetation. <br />As you will note, a stipulation has been included for the final reclamation of <br />the septic system. No bond increase is required as a result of this <br />stipulation. Construction of the leach field may not begin until all <br />applicable permits are obtained by Wyoming Fuel Company.
