EXHIBIT A - Lenal Description <br />(I) The affected area consists of an 23.75 acre portion located within the S 1 /2 of the NW I /4, Section <br />24, T49N, R8W, of the New Mexico P.M., Montrose County, Colorado approximately 6.50 miles <br />west of Montrose, Colorado. This Vac[ and the adjacent surrounding property of 1128 acres is <br />owned by Mr. Nick Gray. A current Mining and Reclamation Permit has been issued for 18.45 <br />acres at the site (Gray Pii #1, M-2003-092). Curzent operations at the site are being conducted <br />under a" Lease Agreement with Option to Buy Material" (10/10/2002) between Mr. Nick Gray <br />and Hard Rock Redi-Mix, Inc. An Extension of Permit Agreement (9/19103) includes the <br />additional 5.30 acres being added to the permit area by this permit revision. Copies of these <br />agreements are contained in Exhibit N. <br />The 23.75 acre tract more specifically described as follows: <br />Beginning at a point where the NW comer of Section 24 beazs N l9 09' 18" W, 2464.93' Thence <br />N 0 E, 60'; thence N 85 2T 18" E, 725'; thence N 68 50' 00" E, 380'; thence S 82 00' 00", 380'; <br />thence S I8 13' 16" E 749.46'; thence N 88 47' 45" W, 442.55'; thence S 88 38' 10" W,96'; <br />thence N 55 59' 13" W, 195.64'; thence N 78 03' S5" W, 179.86'; thence S 44 41' S5" W, <br />172.98; thence 76 44' 36" W, 326.6 l'; thence N 36 43' 44' W, 125 ; thence S 76 44' 36" W, 100'; <br />thence N 36 43' 44" W , 569.19' to the point of beginning containing 23.75 acres <br />Average elevations in and around the proposed area of operations ranges from 6840 to 6980 feet <br />AMSL. <br />Access to the site is by a private road constructed off Colorado Highway 347 approximately'/: <br />mile to the west. A commercial access a[ that point has been installed (constructed June 2002) as <br />per required CDOT specifications and agreements between Hard Rock Redi-Mix and Mr. Nick <br />Gray. This road existed previously as a ditch maintenance road and was improved for truck <br />traffic. The road will remain for the landowners continued use after reclamation activities at the <br />site have been completed. <br />
