The current site, as it exists, and even under the <br /> proposed Amendment, will be in compliance with that particular agreement. <br /> The Division has attempted to demonstrate that they believe that the application and the applicant <br /> have complied with the minimum requirements of the Statute and the regulations of the Permit <br /> Amendment, so therefore, they recommend approval, by the Board, with the stipulations outlined. <br /> Mr. Schwarz reviewed the slides Exhibit 15H-Slide Presentation for the Board. He went on to say <br /> that they have affidavits for two experts: Robert Stecker, Wildlife Biologist and Warren Kemmer, <br /> Plant Ecologist, who could not attend. He summarized the statements into the records by referring <br /> back to Exhibit 15C-Section 18. He also referenced an affidavit in Section 24 from John Ford, Vice <br /> President and Senior Groundwater Hydrologist for Leonard Rice Consulting Engineers (LRCE). <br /> The affidavit was prepared before they received the Division's Response to Comments and it <br /> mirrors the Division's assessment of the issue. Mr. Ford could not attend, but Dennis McGrane, <br /> also a representative for LRCE, was present to answer any questions. Mr. Schwarz also noted that <br /> the document is marked "corrected affidavit" in Exhibit 15C-Section 24. Westem Mobile is ready <br /> to move forward on the top soil issue as soon as it is finalized. <br /> Mr. Parker introduced Delani Wheeler, Deputy Director of the City's Open Space Department. She <br /> referred to the GSI map that was included in the packet while speaking about the wildlife and <br /> groundwater testing. Site went on to say that they had not had the opportunity to conduct any <br /> groundwater testing to establish what the relationship is between the wetlands and habitat and <br /> irrigation water that is seasonally on-site. They are requesting, as a condition, if the Board was to <br /> approve any change, that there would be a study and monitoring program put into place to establish <br /> what, if any, of the relationships are and that if there were negative relationships, that the applicant <br /> would remediate. The City has met with CU briefly to let them know that they would be very happy <br /> to consult with them to help devise the best revegetation plan. The City is very interested in <br /> whatever revegetation takes place on the site, that it takes place soon, so that the chance for weeds <br /> to become established is minimized. <br /> Jeffrey Lipton, Director of Business Services for CU, introduced himself and referenced the letter <br /> they had sent to the Board dated June I Oth from Chancellor Richard Benny. The letter outlined their <br /> interest in the proceedings and their support of the Permit submitted by Western Mobile. He <br /> reconfirmed CU's support on what is being presented to the Board for approval. CU has been <br />
