FORMAL PUBLIC HEARING <br /> WESTERN MOBILE - BOULDER File No. M-81-302 <br /> P.O. Box 18570 F/ <br /> Boulder, CO 80308 <br /> BOULDER COUNTY, Sec. 9 and 16, T 6`h P.M., 112 open pit, 195 acres, gravel. <br /> Operation name: Deepe Farm Pit. Hear objections to staff's recommendation for approval of <br /> Amendment number two with conditions. This Amendment proposes to change the reclamation <br /> plan by reducing the amount of exposed water surface by 33.9 acres which results in a remaining <br /> total of 4.2 acres. <br /> Mr. Ernst, the Pre-Hearing Conference Officer, read the Exhibit 15A-Proposed Pre-Hearing <br /> Conference Order. Under III. Issues to Consider, he stated that the order needed to be changed <br /> from 41 which would now become 42 and 42 would now become #1. Rather the Formal Public <br /> Hearin(; now set for June 26, 1997 should be continued and reset to include considerations of the <br /> proposed changes to the berm in conjunction with and as part of the Amendment. Once that has <br /> been decided it can follow that what is now #1 can become #2. With the proposed changes which <br /> has been styled as a TR and are not now included in the Amendment Application. Proper <br /> constituent part and should be considered as part of the Amendment. Once those two items have <br /> been decided, then it will be determined if the Board will go forward and consider the other <br /> Amendment which has been considered or whether it is under Technical Revision JR) which is <br /> listed in the TR Report. After completing the reading Mr. Ernst submitted it the Board for <br /> consideration for proper procedures to be followed. Exhibit 15B-Amendment to Permit M-81-302. <br /> All persons wishing to testify were sworn. <br /> Alan E. Boles,Jr., City Attorney for the City of Boulder, and Alan Taylor, Civil Engineer and Flood <br /> Control Expert for the City of Boulder (City), introduced themselves to the Board and concurred <br /> with the comments of the Chair that issue #2 should be switched to issue #1 and went on to say that <br /> he thought that issue#l is properly stated. Their concern is that the berm should be included as part <br /> of the Amendment and if the Amendment is considered to include the berm, than the application is <br /> inadequate for not having sufficient information about the effects of the berm and its relationship <br /> with the rest of the property. He also felt that there was not enough hydrological study done at this <br /> point to determine whether the changes adversely impact the groundwater on adjoining City's Open <br /> Space property which contains endangered species of plants and animals. <br /> Jane Bunin, concerned citizen, introduced herself to the Board and stated that she lives near the <br /> property and has also been doing ecological and environmentally related studies professionally for <br />
