Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety received your Technical Revision Application (TR-03) <br />to the NCCI Pit #1, Permit No. M-2001-107. / <br />Upon further review of the application submitted by J&T Consulting, Inc. the Division believes the <br />revised reclamation plan should be an Amendment to the NCCI Pit #1 rather than a Technical Revision. <br />The definition of Amendment as described in the Construction Material Rules and Regulations "means a <br />change in the permit or an application which increases the acreage of the affected land, or which has a <br />significant effect upon the approved or proposed Reclamation Plan." The reclamation plan will be <br />significantly revised under this proposed plan with the creation of one large lined lake 65.77 acres in <br />size rather than seven smaller lined lakes ranging from 7.07 acres in size to 12.27 acres in size. In <br />addition, the operator was to mine no more than 10 acres that would cover one section or portions of two <br />sections and with a total disturbance at any time of 25 acres. The larger compacted lined reservoir is <br />significant regazding possible impacts to the hydrologic balance, impacts to surrounding property <br />owners and the approved postmining land use. <br />Please resubmit this revision as a Permit Amendment Application. Applications for Amendments aze <br />reviewed by the Division in the same manner as applications for new permits and require a fee of <br />$1,938.00. Please instruct the Division if you would like the $188.00 Technical Revision application fee <br />returned, or applied to the cost of the Permit Amendment. In doing so, Northern Colorado Constructors, <br />Inc. Aggregate Div. will need to formally withdraw the request for the Technical Revision. The <br />withdraw notice must be received by the Division prior to the Division's decision due date of November <br />9, 2006. If the notice is not received by this date, the Division will have to deny the application. <br />The Division has a few other comments and suggestions regazding the application that will need to be <br />addressed in the future submittal; <br />1. The operator should be awaze that any reduction in acreage must be filed as an acreage release <br />request in accordance with Rule 4.17 of the Construction Materials Rules and Regulations. <br />Please send the request as a separate correspondence from any future revisions. <br />Office of Office of <br />Mined Land Reclamation Active and Inactive Mines <br />
