RE: 2"a Adequacy Review Comments -River Valley Resource, Amendment Application
Class: Revision, Type-Seq.: AM-1, Permit No. M-2001-090
Dear Mr. Rozelle:
Listed below are remaining adequacy review comments on the above-captioned Regular 112
Amendment application that require either clarification or resolution. These comments are based
on our review of your August 14 and 19, 2003 adequacy responses. Our review of Exhibit N -
12ight of Entry documents is still pending and we will forward any review comments as soon as
they become available. in order to facilitate a hearing before the Mine Land Reclamation Boazd
during the September 23-24, 2003 Meeting, the Division has kept your recommended decision
date of September 9, 2003, Therefore, we would appreciate a response from you on or before
September 2, 2003. (Please be sure to include two (2) copies of your response.) Please be
advised that your amendment application maybe deemed inadequate and may be denied on
September 9, 2003 unless the following adequacy review items are addressed to the satisfaction
of the Division.
6.4.4 EXHIBIT D -Mining Plan
1. The December 5, 2001 adequacy response, to the original August 31, 2001 application,
provided by the Applegate Group, Inc. provides the following commitment: "Prior to the
relocation of the Suttle Ditch, the applicant will provide the Division a copy of an agreement
with the downstream users of the ditch on any terms and conditions associated with relocating
the ditch." Therefore, we understand that Lafarge West, Inc. will provide the Division with a
signed and notarized agreement with the owners of the Suttle Ditch prior to any relocation.
Please confirm.
2. The Division requests that Lafazge West, Inc. (LFI) clarify whether they intend to excavate
within 200 feet of the existing location of the Suttle Ditch and then relocate the existing ditch to
within 10 feet of the crest of the backfilled pit walls to a 3:1 slope, or whether the Suttle Ditch
