This hearing was requested by the City of Boulder, as an appeal <br /> to the Division's decision that the permit modification proposed would be reviewed as a <br /> technical revision. At the hearing, the Mined Land Reclamation Board determined that the <br /> permit modification submitted on May 2, 1997 was a technical revision, not an amendment. <br /> The Board ordered the Division to solicit comments from parties that may be interested in <br /> the technical revision application, but to make a decision on the application within the <br /> regulatory time frame for a technical revision. The Board further ordered the Division to <br /> prepare a document describing the rationale for the Division's eventual decision on the <br /> technical revision TR-06 application. This document is intended to execute the Board's <br /> order in that regard. <br /> Solicitation of Comments <br /> In order to carry out the Board's direction to solicit and consider comments from interested <br /> parties to the technical revision TR-06 application, the Division took the following steps: <br /> 1. The Division applied the public notice procedures to technical revision TR-06 that <br /> would normally be applied to a new application for a Limited Impact (type 110) <br /> Permit. These procedures were deemed appropriate, because the new Limited Impact <br /> (type 110) Permit review and decision time frame of 30 days are the same as the <br /> review and decision time frame for technical revisions. The public notice procedure <br /> followed by the Division included a one-time publication in a newspaper in general <br /> circulation in the area of the proposed activity. This newspaper was the Boulder <br /> Daily Camera, and the publication of a notice soliciting comments on the technical <br /> revision TR-06 application occurred on August 21, 1997.
