Cattany <br />Division DlfeC[Or <br />Natural Resource Tmstee <br />The Division of Reclamation, Mining and Safety received Technical Revision 01 ("TR-Ol") for the <br />Connell Resources Inc. Wellington Downs Pit, Permit No. M-1995-035. The revision was submitted to <br />abate problems noted during the Division's Mazch 28, 2006 inspection. The Division has the following <br />items that need to be addressed prior to approval of the revision. <br />1. The revision addresses storm water leaving the Lafazge's Weitzel Pit (M-1986-050) that will be <br />routed into a channel east of the Wellington Downs Pit. The Division is uncleaz as to where water <br />will flow beyond this ditch. Please explain where the water will continue to flow and demonstrate <br />that existing structures are able to handle the designed flow. <br />2. Please state if the ditch east of the Wellington Downs Pit is an existing ditch and if the ditch is located <br />within the Wellington Downs permit boundary. <br />3. Please be aware that the dischazge of the mine water from the Wetizel Pit may require a National <br />Pollutant Discharge Elimination System (NPDES) permit by the Colorado Department of Public <br />Health and the Environment. Please contact that agency regarding the need for a permit. <br />Please be advised that the Wellington Downs TR-O1 Application may be deemed inadequate, and the <br />application may be denied on November 20, 2006 unless the above-mentioned adequacy review items are <br />addressed to the satisfaction of the Division. If you fee] more time is needed to complete your reply, the <br />Division can grant an extension to the decision date. This will be done upon receipt of a written waiver of <br />your right to a decision by November 20, 2006 and request for additional time.
