Colorado 60631 (970) 3569160 Re: Petition To Be Party at Formal Hearing for Sokol Pit, File No. M-1980-193 To whom it may concern ; Per my conversation with Mr. Tyson Powell I hereby formally petition the Mined Land Reclamation Board to be a party to the proceedings in the Sokol Gravel Pit, File No. M-1980-193. We feel that the Upper Black Squirrel Creek Ground Water Management District should have been notified and given the opportunity to comment on the application. You notified the El Paso County Commissioners and the El Paso County Planning Department, and as such our entity should have been notified, and C.R.S.34-32.5-116(m) reinforces that (please see attached documentation describing the Upper Black Squirrel Creek Ground water Management District). We are a taxing district in EI Paso County, and all plans that concern water in the Upper Black Squirrel Creek Designated Basin are to be sent to'our office for Board review and comments if necessary. Being as this did not occur it took concerned citizens of the District to bring this application to our attention. We ask that in the future you notify the Upper Black Squirrel Creek Ground Water Management District of any application that is within our district boundaries. The Upper Black Squirrel Creek Ground Water Management District has the following objections to the application: a. No static levels have been given for well data. b. They have-not applied for well permits, but claim no injury to aquifers. c. Possibility of exposing groundwater. d. No test hole data to prove depth of ground water.
