EXHIBIT D <br />MINING PLAN <br />RULE: 3.1.6(1) <br />3.1.6 Water -General Requirements <br />116(9)(h) (1) Hydrology and Water Quality: Disturbances to the prevailing <br />hydrologic balance of the affected land and of the surrounding area <br />and to the quantity or quality of water in surface and groundwater <br />systems both during and after the mining operation and during <br />reclamation shall be minimized by measures, including, but not <br />limited to: <br />6.4.4(c) <br />6.4.4 S~iIBIT D -Mining Plaa <br />The mining plan shall supply the following information, correlated with the <br />affected lands, map(s) and timetables: (a) all water diversions and <br />impoundments; <br />1.Office of the State Engineer <br />Division of Water Resources <br />°°Response to Reclamation Permit Application Consideration" draft <br />Received by Fax on January 6, 2006, per request from objectors, <br />Division of Minerals and Geology indicated that no comment had been received <br />from the Water Resources Div However, Water Resources had no record of <br />receiving the letter of request and immediately responded with the attached <br />information. <br />This information relates back to our concerns as demonstrated in Objector <br />Exhibit C, (1) & (2). <br />2. Applicants Exhibit D, for comparison to other relevant information <br />(narrative & map, attached). <br />3. Letter from Upper Black Squirrel Creek, Ground Water Management Dist., <br />520 Colorado Ave., Suite C, Calhan, Colorado, 80808 (Another comparison of <br />applicants hydro~eological existence). <br />4. Photos <br />S. Objectors will be testifying about conversations with various Local, State & <br />Federal agencies. <br />
