I <br />own over 400 acres immediately adjacent to the Platte Sand and Gravel area <br />to the north and west. <br />As you know, in the original mining permit application approved on June 27, <br />2001, conditions to the approval were noted and stipulated. These <br />stipulations called for installation of recharge structures between the <br />points of dewatering and our wells adjacent to the operation. The idea, of <br />course, was to protect the adjacent wells while any dewatering activities <br />were occurring. <br />Design and construction format was prepared and accepted by my consultant, <br />specifically Mr: Forrest Leaf, and my attorneys Kim R. Lawrence and T. <br />Andrew Jones had input into the design and side agreements that were made. <br />As you also know, Mr. Sharkey and his company agreed to make me whole in the <br />event that the dewatering activities injured any of my irrigation wells. <br />Also, agreement not to dewater more than one acre in the entire permit site <br />at any given time was also agreed to. Furthermore, Platte Sand and Gravel <br />agreed not to conduct any dewatering activities until the recharge <br />structures were constructed. <br />My understanding is that this new request, is construction of a slurry wall <br />before any dewatering and dry mining activities are undertaken. The critical <br />point to my objection is to ensure that previous stipulations of <br />responsibility for potential are maintained by the applicant. <br />I would request the Division of Minerals and Geology ensure that prior <br />agreements are maintained and held in force and that the applicant continues <br />to agree not to harm or injure any of my irrigation wells. <br />
