<br />Observations <br />1 -The need for a TR and associated bonding to accommodate a revised <br />mining/neclamation plan: <br />Enclosed please find the revised mine and reclamation plans provided to us by Elk <br />Creek. Please note that we were not provided with any calculations concerning the cost <br />of reclamation. ff this is a follow-up issue, we will try to deal with it later. <br />2 -Concerns the stability assessment: <br />Enclosed please find an analysis completed by Brierley Associates that, to the best of <br />our knowledge, was utilized by Elk Creek to prepare the mine plan. <br />3 =Concerns benches and highwalls plus final reclamation: <br />The enclosed reclamation plan narrative and map should adequately address these <br />issues. <br />4 -Concerns the need for the revised plans to recalculate financial warranty: <br />These concerns are addressed in the above referenced documents, <br />5 - Concerns the gym, a human waste holding area and a small storage yard for <br />propane tanks: <br />The gym building is owned by Mr. Peterson and he has represented to me that the <br />facility has been closed and no longer in operation. He has also stated and committed <br />to removing the port-o-pots (human waste holding area) and the propane tanks as soon <br />as weather permits. He has also stated that you have given him until mid-April of this <br />year to complete this removal. I do not have a copy of the letter sent by you to Mr. <br />Peterson that sets the exact deadline for removal. <br />6 -Concerns the same as item "5" above however addresses the potential that <br />some of the tanks were leaking and that you sent a copy of this report to both <br />CDPHE and Corps of Engineers: <br />it was reported to me that the Jefferson County Health Department has inspected these <br />tanks and that they were found not to be leaking. We do not have any copies of <br />correspondence you may have received from CDPHE or the Corps. Removal of these <br />facilities by April should correct any problems that may exist, 'rf any. <br />7 - Concerns a garbage dump: <br />Mr. Peterson is committing to total removal of this garbage dump by your mid-April <br />deadline. <br />8 -Concerns "solid waste° stashed in a ditch: <br />This "solid waste" will also be removed by the mid-April deadline. <br />9 - Concerns a 300 gallon and a 3,000 gallon tank: <br />These tanks will also be removed by the mid-April deadline. <br />10 -Concerns the public gym: <br />As mentioned above, the gym has been closed and it will remain closed. <br />Problems/Possible Violations and Corrective Actions <br />1 -Concerns structures, etc. that may be wkhin the permit area and are not part of <br />the approved mining and reclamation plan: <br />We believe that all of these issues have been adequately addressed above. <br />2 -Concerns the need for a TR or Amendment with a new bond calculation: <br />As per our conversation last week, you advised that a TR is necessary and not a permit <br />amendment. We believe that all of the enclosed documents satisfies this requirement <br />with the exception of a bond calculation as mentioned above. <br />2 <br />
