Long <br />Division Director <br />Citizen Participation in the 112 Reclamation Permit Application Process <br />Revised October I9, 200I <br />INTRODUCTION: <br />Thank you for faking the time to be involved in the State of Colorado's process of <br />reviewing applications for new (or revisions to existing) mining operations. The <br />purpose of this memo is to explain-the 112 Reclamation Permit application <br />process, your rights as either_a parry or a non party,_ and the jurisdiction of_the _ <br />Mined Land Board. The Office and Board operate under the provision of the <br />Construction Materials Act (Act), if the application is fox the extraction of <br />construction materials. VVe operate under the Hardrock Act (Act), if the <br />application is for the extraction of non-construction materials. <br />If an application fora 112 Reclamation permit for a Construction Materials or <br />Hardrock operation is approved by the Board or Office, the approved permit is for <br />the life of the mining operation (Life of Mine) since our permits have no expiration <br />date. The permit may be revoked and the reclamation bond forfeited to the State <br />only by an action of the Mined Land Reclamation Board. Revocation and <br />forfeiture may occur due to an uncorrected violation of the Act, Rules and <br />Regulations, or the terms of the approved permit. <br />THE ROLE OF THE MINED LAND RECLAMATION BOARD BOARD): <br />The Mined Land Reclamation Board (NLRB or $oard) is aseven-member Board <br />that serves at the pleasure of the Governor.
