As discussed with Tom Logue previously, the notices to the Commissioners and the SCD <br />included an incorrect timeframe for public comment. The public comment period for an <br />amendment to a 112c permit is 20 days following the fourth of four consecutive weekly <br />publications of the public notice. I understand that corrected notices have since been delivered. <br />Please submit copies of the revised notices and the required proof of mailing or hand delivery. <br />Exhibit S -Permanent Man-made Structures <br />45. Please submit documentation addressing the concerns expressed by the Army Corps of <br />Engineers, concerning on-site wetlands, in their letter dated March 13, 2003. <br />47. Please provide an engineering demonstration that verifies the embankment to the north of the pit <br />will remain stable with a sediment pond located on the crest of the slope, potentially leading to <br />intermittent saturated conditions in this embankment. Otherwise, please propose an alternate <br />location for the pond and associated drainage ditches that is an adequate distance from the <br />embankment that infiltration of water from the pond will not affect the embankment stability. <br />48. Please submit proof of publication of the public notice for this amendment, and proof that all <br />owners of record of property on or within 200 feet of the proposed affected area have received <br />copies of the public notice as required by Rule 1.6.2(1)(d) and (e). <br />
