The Animas Consolidated <br />Ditch Company was not noti5ed of these plans or asked for comment, as we should have been, since the <br />ditch is on the west boundary ofthe permit area. The ditch company aggressively protects easements and <br />resists encroachments along the ditch bank. We would like to be informed of all planned activity that could <br />affect the ditch. <br />We have two concerns about this proposed mining: <br />• Wa[er from the Animas Consolidated Ditch cannot be used for mining, and can only be used for <br />agricultural purposes. <br />• The ditch company is aware that our diversion must be cleared periodically from natural erosion, <br />but we are extremely concerned that the proposed plans for the mining would compromise the <br />ditch diversion through headward erosion. If this should happen, the ditch company will hold <br />the mine operators responsible for mitigating aad correcting the problem.
