~ . <br />Tanabe Pit <br />AGREEMENT FOR COMPENSATION <br />(MAN-MADE STRUCTURE WITHIN 200 FEET) <br />Colorado Stale law requires that man-made stmcmres within 200 feet of a mining operation be given special <br />consideration. If the mining operation damages a ntan made structure within 200 feet, the mining operator will <br />repau the structure, replace dte structure, or compensate the owner of [he structure its fair market value. Maps in the <br />vicinity of the proposed mining operation indicate [hat you own a structure within 200 feet of [his proposed perrttit <br />boundary. The mining operator further agrees to indemnify and hold Touch America harmless front any oC[he loss <br />or damage arising from [he mining operator's activities a[ [he Tanabe Pit site. <br />Name of Structures: Fiber Optic Lines in western ROW of Brighton Road from 112'" Ave to a point 2,100 feet to <br />the south along Brighton Road, along with Fiber Optic Lines in the southern ROW of 1121h Ave. from Brighton <br />Road to a point 1,000 feet east along 112ih Ave. <br />By signing the agreement, the owner of [he structure acknowledges that they have been informed of the permit <br />application and agree to the artangement of repair, replacement, or compensation if the mining operation damages <br />any of his structures.
