CONDITIONS FOR APPROVAL
® The proposed operation does not anticipate exposing growdwater. Therefore, exposure of ground water must not
occur during or after mining operations.
® The proposed operation will consume ground water by ^evaporation, ®dust control, ^reclamation, ^water
removed in the mined product, ®processing, ^other. Well Permit No. 41824-F-R is valid for the withdrawal of
45 gallons per minute, up to 61.6 acre-feet annually, from the Elam Well No. I for industrial purposes and the
irrigation of a maximum of 20 acres, pursuant [o the augmentation plan decreed in Case No. SOCW296. See
comments below for more information.
^ Prior to approving a well permit, the applicant must conduct a field inspection of the site and document the
locations of all wells within 600 feet mile of the permit area. The applicant must then obtain a waiver of
objection from al) well owners with wells within 600 feet of the permit area or contact this office regarding the
600 foot spacing notification hearing process.
^ The proposed operation may have potential impact on existing water rights near the project location. Please
provide evidence that the proposed project will not alter or impact the historic operation of existing water rights.
^ The applicant has indicated plans to use other water for: uses at the permit site, _storage in the excavated
area(s). The applicant will need to provide evidence to this office that the water is permitted or decreed for such
uses.

COMMENTS: The decree in Case No. 80CW296 also allows the Elam Well No. 1 to be used as an alternate point of
diversion for the Collins Creek Ditch Extension water right. The total maximum pumping rate under all water rights
decreed to the well is 230 gallons per minute, with the total annual appropriation amount limited to 70 acre-feet. The
plan for augmentation specifies that daily usage shall not exceed 55,000 gallons per day. The proposed operations
conform to these limits. If the well is not operated in accordance with the terms of said decree, it will be subject to
administration including orders [o cease diverting water,
