The <br />recommended decision date for your application is scheduled for October 13, 2004. Therefore, I <br />would appreciate a response from you on or before October 8, 2004. (Your response should <br />include two (2) copies, one bound, one unbound). The remaining adequacy review comments aze <br />consistent with the numbering sequence used in the Division's previous June 9, 2004 adequacy <br />letter. Any review comments in addition to the original numbering sequence are so noted. <br />Please be advised that your amendment application maybe deemed inadequate and the Division <br />may recommend a decision of denial on October 13, 2004 unless the remaining adequacy review <br />items are addressed to the satisfaction of the Division. <br />6.4.4 EXHIBIT D -Mining Plan <br />11. De-Watering -Mitigation Measures: Please verify whether VCI will implement mitigation <br />measures, as approved by the Division, in response to the drawdown to the groundwater surface <br />at the Carbaugh well as detemvned in the CGRS Dewatering Evaluation Report. <br />6.4.5 EXHIBIT E -Reclamation Plan <br />16. Flood Control /Mitigation Plan :VCI has offered to submit a finalized Flood <br />Control/Mitigation Plan to the Division in the form of a technical revision, and has projected that <br />up to 9 months maybe required to produce such a plan. The Division requests that VCI provide <br />an estimated timeline outlining action dates by when the various steps involved in developing <br />such a finalized plan will be completed, and a commitment to provide updates to the Division <br />Office of Office of Colorado <br />Mined land Reclamation Active and Inactive Mines Geological Survey <br />
