Dolan / <br />Post Office Box 757 ~ ~ ©I,j, QC ~b(' <br />Kremmling, CO ge~po/~s-e <br />Re: Henderson Mine Reclamation Permit Amendment, AM-05 / IVl ' 1 ~/ ~7~ 3~Z <br />Dear Mr. Dolan: <br />This letter is to follow up our discussions regarding your concerns about Climax Molybdenum Company's <br />pending application with the Colorado Mined Land Reclamation Board ("Board") to amend the <br />reclamation permit for the Henderson Mine and Mill ("Amendment AM-05"). <br />It is my understanding that your objection to Amendment AM-OS is based on the concern that the Board's <br />approval of the proposed Deep Underground Science and Engineering Laboratory ("DUSEL") as a post- <br />mining land use at the Henderson Mine and Mill might vest local, state or federal governments with a <br />property interest in the Henderson Mine or Mill. <br />This is to assure you that this would not be the case. No property interest of any kind will be transferred <br />as a result of the Board's approval of AM-O5. The effect of Board's approval of DUSEL as apost-mining <br />use will be limited to the Board's regulatory authority under the Colorado Mined Land Reclamation Act, <br />and would in no way constitute an assumption by local, state, or federal governments of a property <br />interest in the Henderson Mine or Mill. <br />If our communications satisfy your concerns over the issuance of Amendment AM-05, we respectfully <br />request that you withdraw your opposition to issuance of this permit. If I can address any additional <br />concerns you may have regarding Amendment AM-O5, please do not hesitate to call me.
