The Division of Minerals and Geology ("Division") is required <br />to make an approval or denial decision no later than December 26, 2005, therefore, your response to the <br />following adequacy review concerns should be submitted to the Division as soon as possible. <br />1. As required by Rule 1.6.5 (2), please submit the proof of publication of the public notice circulated in <br />the local newspaper and all owners of record of surface lands, and easement holders that are within <br />200 feet of the boundary of the affected land. Proof of notice may be return receipts of a Certified <br />Mailing or by proof of personal service. <br />2. The application is listed as 186 acres of current disturbance and will be increased 55 acres for a total <br />of 241 acres. In the Acreage Reduction Application ("AR-01 "} approved by the Division on July 25, <br />2005, the site was released of 47 acres (from 232.5 acres to 185.5 acres). Please see the Division's <br />approval letter for the acreage reduction. The Division's records indicate that 185.5 acres is permitted <br />vs. the application page of 186 acres. Please clarify this discrepancy. <br />3. The operator for the Kauffman Pit, File M-1978-327 will need to submit an acreage reduction request <br />for the area that will be included in this AM-O1 application (55 acres). At the request of the operator, <br />the approval for the acreage reduction will be approved concurrently with the AM-01 application and <br />submittal of any new required bond (the operator will need to waive the timeframes associated with <br />the acreage reduction so they may occur concurrently). In order to avoid another inspection of the <br />site, the acreage reduction request must be submitted within 60-days of the Division's inspection of <br />November 8, 2005. <br />Rule 6.4.3 Exhibit C- Pre-Minin7r and Mining Plan MapL) of Affected Lands <br />4. Exhibit C-1 depicts the Wagner/Kauffman Pit #3 permit area in addition to the Kauffman Pit permit <br />area (DMG permit M-1978-327). The Kauffman Pit area depicted as "Area Backf fled for Recyclable <br />Concrete and Asphalt Storage and Processing" was approved under TR-04 in 2000 as for storage of <br />concrete and asphalt only and does not include backfilling of the material.
