We had agreed that sixty (60) <br />days, from the date of the inspection, would be adequate time to prepare and submit the <br />document. As noted in the June 25, 1997 inspection report, the due date for submittal of the <br />amendment application was August 25, 1997. However, Mr Klco asked for, and the Division <br />approved, another extension of the due date. The new date for submittal of the amendment <br />application is September 22, 1997. A Reason to Believe letter (for a possible violation) may be <br />sent to G-P if the Division does not receive a complete amendment application by 8:00 F,M, <br />September 22, 1997. <br />In addition, as we also discussed, reclamation of the site must be completed by October 16, 2000 <br />as ordered by the Mined Land Reclamation Board on October 17, 1995 (a five year reclamation <br />period). Mr Klco feels it will take five (5) years from now to finalize reclamation. Since the <br />Board ordered the five year limit for reclamation the Division will not consider any extensions of <br />the time limit. So, if the operator needs two additional years to complete reclamation, the Board <br />should be petitioned for reconsideration oftheir previous decision pursuant to the requirements <br />of Rule 2.9.1. The Division can schedule the request at the September 24-25, 1997 Board <br />Hearing if you submit the petition to the Division by September 8, 1997. If the Board denies the <br />extension request, reclamation must be complete by October 16, 2000. <br />If you have any question, please give me a call. <br />
