The wildlife statement was sent based on the origina:. mining application by Battle Mt on 1/27/89. The letter was sent in response to a proposed amendment to the original permit. The amendment proposed some changes, which elevated the question of open pits and wildlife contact. This was reflected in the letter. Fencing and/or covering are possible methods that thc~ company can undertake to address the issue. The Division of Wildlife cannot require the Battle Mss Company to do anything in regards to wildlife. We can only comment and recommend as to the wildlife impacts and concerns. I-~ is then the responsibility of the permitting agency, in this cas~a the Mined Land Reclamation Division, to place into the permit .any terms related to wildlife impacts addressed by the Division of Wildlife.
