The letter was sent in <br />response to a proposed amendment to the original permit. The <br />amendment proposed some changes, which elevated the question of <br />open pits and wildlife contact. This was reflected in the letter. <br />Fencing and/or covering are possible methods that thc~ company can <br />undertake to address the issue. <br />The Division of Wildlife cannot require the Battle Mss Company to <br />do anything in regards to wildlife. We can only comment and <br />recommend as to the wildlife impacts and concerns. I-~ is then the <br />responsibility of the permitting agency, in this cas~a the Mined <br />Land Reclamation Division, to place into the permit .any terms <br />related to wildlife impacts addressed by the Division of Wildlife. <br />The DOW has no recourse if such recommendations are :zot placed in <br />as conditions of the permit. <br />DEPARTMENT OF NATURAL RESOURCES.
