Catlany <br />Division Director <br />Natural Resource Trustee <br />Listed below is an adequacy review comment for the Koenig Pit 112(c) Technical Revision Application, File No. M- <br />1980-120. The Division of Minerals and Geology ("Division") is required to make an approval or denial decision no <br />later than January 30, 2004 therefore, your response to the following adequacy review concern should be submitted to <br />the Division as soon as possible. <br />Rule 6.4.3 Pre-minine and Minim Plan Map(s) of Affected Lands <br />1. Section (c) of the Pre-mining and Mining Plan Map(s) of Affected Lands requires the Applicant to specify the total <br />area to be mined and the area of affected lands. The information submitted with the TR application does not <br />indicate the dimensions of or the expected azea to be affected by the access road to the site. Please specify the <br />dimensions of the proposed roadway affiliated with then new access to the site. <br />Please be advised that the Weld County, Koenig Pit, 112(c) Technical Revision Application may be deemed <br />inadequate, and the application may be denied on January 30, 2004 unless the above-mentioned adequacy review item <br />is addressed to the satisfaction of the Division. If you feel more time is needed to complete your reply, the Division <br />can grant an extension to the decision date. This will be done upon receipt of a written waiver of your right to a <br />decision by January 30, 2004 and request for additional time.
