Please consider this <br /> letter to be a letter of objection supplementing our initial <br /> letter of objection on this application dated April 17 , 1997 . We <br /> are submitting this supplemental letter within five days <br /> following the informal pre=earing conference, as your rules <br /> require. <br /> We have two additional objections to make to the amendment <br /> application. First, the amendment application is deficient in <br /> that it does not include the levee embankment (or so-called berm) <br /> which predated the original application for the Deepe Farm Pit, <br /> but has been substantially modified during the permit's term. We <br /> included this objection in our April 17 letter. However, we <br /> learned at the May 6 conference that Western Mobile, following <br /> the submission of the pending amendment, applied for a "technical <br /> revision." to the plan to include certain proposed changes to the <br /> berm.
