III 999
RECEIVED
BEFORE THE MINED LAND RECLAMATION BOARD JUN 0 5 1997
STATE OF COLORADO Division of Minerals& Geology
File No. M-81-302
PRE-SEARING STATEMENT OF INTERESTED PARTY (OBJECTOR) BOARD OF
COUNTY COMMISSIONERS OF THE COUNTY OF BOULDER
IN THE MATTER OF THE WESTERN MOBILE - DEEPE FARM PIT - AMENDMENT
02
The Board of County Commissioners of the County of Boulder (BOCC)
submits this pre-hearing statement for the pre-hearing conference .
scheduled in this matter for June 5, 1997. By this statement,
the BOCC expresses its wish and intention to be an objecting
party before the MLRB at the hearing scheduled on this amendment
application for June 25 or 26, 1997.
Party's Name: Board of County Commissioners of the County of
Boulder (BOCC) .
List of Witnesses: The BOCC anticipates presenting testimony to
the MLRB through its authorized staff in this matter, who are
expected to include the following:
1. Curt Parker, Floodplain Engineer, Boulder County
Transportation Department, who is expected to testify concerning
the content and significance of the ongoing Urban Drainage and
Flood Control District (UDFCD) study of the South Boulder Creek
Floodplain in the vicinity of the Deepe Farm Pit, and the
advisability of the MLRB denying the proposed amendment until
that study is complete, or imposing a condition on any approval
which would require the Applicant Western Mobile to take
appropriate flood mitigation measures within the permit area (and
including the berm) once the study's results are available. Mr.
Parker also is expected to testify concerning the flood control
significance of the berm and recent structural modifications to
the berm, as a basis for the County's argument that the berm is
properly part of this amendment and should not be separately
reviewed as a technical revision. Mr. Parker also may testify to
the flood control implications of the other internal drainage
changes associated with this amendment.
1
