SHELTON, Director
Richard D.Lamm
Governor
e
June 5, 1985
Mr. Jerold L. Trupp
Attorney at Law
455 Dodge St.
Delta, Colorado 81416
Re: Hallenbeck Pit No. 1
File No. 77-62
Dear Mr. Trupp:
Our Division has received and reviewed the $5,000.00 letter of credit from the
United Bank of Delta on behalf of Benson Brothers. I note that no number was
given to this letter of credit. Pleas ify with the United Bank of Delta
what this number should be and have them authorize us to fill in that number
on the letter of credit. It will then be acceptable as the replacement for
the previously submitted letter of credit no. A0192 in the amount of
$2,600.00, and that letter of credit will then be returned.
In my letter to you of November 2, 1984 I outlined the items needed to
complete the succession of operators submission for the transfer of
permit no. 77-62 to Benson Brothers. I have enclosed a copy of that letter
and have indicated on it (by arrows and underlining) the two items still
needed. I have once again enclosed a blank financial warranty-letter of
credit form (on which you should reference the number of the new $5,000.00
letter of credit, said number to be supplied by the United Bank of Delta) and
a blank 110 permit application form. Submission of these two items (filled
out as indicated in my November 2, 1984 letter) will complete the items
necessary for the Mined Land Reclamation Board to approve the succession of
operators and transfer of permit to Benson Brothers (hopefully, during the
June 25-26, 1985 Board meeting) .
Concerning your question on annual reports and fees, I suggest that Benson
Brothers proceed to submit the $50.00 fee and accompanying delinquent annual
reports (progress in mining and reclamation during the last four years and
plans for next) as soon as possible. If these items are not up to date, the
Board cannot approve the request for the transfer of the permit.
Please call me if you have any further questions.
Sincerely,
q11.
