RECEI V;~p <br />BEFORE THE MINED LAND RECLAMATION BOARD JUL 0 g ~ <br />STATE OF COLORADO <br />Q+ylaiop of MineraLend Geology <br />FINDINGS OF FACT, CONCLUSIONS OF LAW AND ORDER <br />IN THE MATTER OF THE 112c PERMIT AMENDMENT APPLICATION OF <br />AGGREGATE INDUSTRIES - WCR, INC., FILE NO. M-1999-034, AMENDMENT <br />NO.1. <br />THIS MATTER came before the Mined Land Reclamation Board on June 25, <br />2003 in Denver, Colorado for a hearing on an application to amend 112c reclamation <br />permit file no. M-1999-034 by Aggregate Industries-WCR, Inc. (Applicant), in <br />accordance with C.R.S. § 34-32.5-114. Mike Refer and Robert Fleming appeazed on <br />behalf of the Applicant. Steve Brancucci appeared on behalf of Objector Kazen Topper <br />(Objector). Larry Oehler appeazed on behalf of the Division of Minerals and Geology <br />(Division). <br />The Board, having considered the parties' presentations and having been <br />otherwise fully informed in the premises, hereby enters the following findings of fact, <br />conclusions of law and order: <br />FINDINGS OF FACT AND CONCLUSIONS OF LAW <br />1. The Applicant seeks to amend its Section 112c reclamation permit to add <br />approximately fifty acres to its surface sand and gravel pit known as the Cooley <br />Reservoir and Fulton Wildlife Area pit located in Section 16, T2S, R67W, b`~ P.M., <br />Adams County, Colorado. The Applicant proposes to add this area to the northeast <br />comer of its permit area. The proposed amendment area lies immediately west of the <br />Objector's property and east of the Fulton Ditch. <br />
