M-1999-034 <br />THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br />October 29, 2003, in Denver, Colorado for a hearing to consider the request of a party <br />objector to modify an existing Boazd Order. The Boazd Order was issued June 25, 2003 <br />concerning the amendment application of Aggregate Industries WCR, Inc., file number M- <br />1499-034. Larry Oehter appeazed on behalf of the Division of Mines and Geology <br />("Division'. No appearances wece made on behalf of the Applicant or any party objectors. <br />The Board, having considered the parties' presentations and having been otherwise fully <br />informed of the facts in this matter, hereby enters the following findings of fact, conclusions of <br />law and order: <br />1. On June 25, 2003, the Applicant obtained Board approval for an amendment to an existing <br />surface sand and gravel pit Imown as the Cooley Reservoir and Fulton Wildlife Area pit <br />located in Section l6, Township 2 South, Range 67 West, 6a' Principal Meridian, Adams <br />County, Colorado. <br />2. Condition no. 2 of the Board's Order required the Applicant to sample Karen Topper's <br />domestic welt, permit no. 2455, for the presence of diisopropylmethylphosphate (D)MP) <br />prior to and after de-watering of the pit. <br />In correspondence to the Division dated August 18, 2003, Ms. Topper indicated that the <br />Board's Order described the wrong well to be tested for DIMP. The correct well to be <br />tested is Ms. Topper's alluvial irrigation well, permit no. 32883, not her domestic well. <br />
