MINERAL LEASE
Lease made this--b��day of_MA _, 2001 between EUGENE G. GRIFFIN,
County of Fremont, State of Colorado, herein referred to as Lessor, and THE COUNTY
OF FREMONT, doing business art 615 Macon Ave, City of Canon City, County of
Fremont, State of Colorado,herein referred to as the Lessee.
In consideration of the sum of 10 dollars paid to her by Lessee, receipt of which is
acknowledged, the royalties reserved herein, and the covenants and conditions contained
herein, Lessor hereby leases to Lessee, for the purposes set forth herein, all sand and
gravel contained in and lying on and under the following described real property in
Fremont County, State of Colorado, containing 37.57 acres more or less:
Beginning at the E Y. OF Section 23, Township 20 South, Range 71 West, of the
6'h Principal Meridian:
Thence North along the East line of said section 23 a distance of 94 Feet,
Thence N 87°18' W a distance of 325 Feet,
Thence S 62°37'04" W a distance of 1407 Feet,
Thence S 27°35' E a distance of 138 Feet,
to the true point of beginning.
Thence N 150 W a distance of 1275 Feet,
Thence S 62° W a distance of 1410 Feet,
Thence S 23' E a distance of 1240 Feet,
Thence N 62° 19' 39"E a distance of 1231.28 Feet,
back to the true point of beginning.
Circumscribing an area of+/- 37.57 acres.
Such real property being referred to herein as the demised premises.
MINING RIGHTS: Lessee shall have the exclusive right to mine, extract, and
remove: all economically recoverable sand and gravel in or under the demised premises
for the exclusive benefit and use of Lessee, and to conduct such mining operations by
such method as Lessee shall determine.
Lessee shall have the unrestricted right to use the surface and subsurface of the
demised premises for any purposes in connection with its mining operations on such
premises. The right granted Lessee hereunder shall include, without limitation, all
mining rights, privileges, fianchises, and immunities of every kind of nature whatsoever
that are necessary or convenient, or that Lessee in its judgment shall deem to be
necessary or convenient, for carrying on mining operations, or for mining, extracting and
removing, all sand and gravel contained in or under the demised premises.
I
