We note for the record that your objectir~n was not <br />submitted in a timely manner as required by the regulations of the <br />Mined Land Reclamation Board and accordingly your request: for party <br />status may not be appropriate. Nevertheless, we are forwarding you <br />a copy of Battle Mountain's adequacy response as required by the <br />prehearing order issued by the Mined Land Reclamation Board for <br />this proceeding. Our transmittal of the adequacy response document <br />should not be interpreted as acknowledgement of your party status <br />and we specifically reserve our right to challenge party status <br />when that issue is debated before the Mined Land Reclamation Board. <br />
