The Division determined that no <br />emission permit will be required for the above referenced source since the production rate will be 70,000 tons per year <br />or less. An Air Pollutant Emission Notice is required, however, since uncontrolled emissions of particulate matter wilt be <br />more than 2.0 tons per year. <br />This exemption from permit requirements is issued in reliance upon the accuracy and completeness of information <br />supplied by the applicant and is conditioned upon construction, installation, and operation in accordance with this <br />information and with representations made by the applicant or the applicant's agents. Specifically, this exemption has <br />been granted provided that the following information is accurate and complete: <br />The production rate does not exceed 70,000 tons per year. Annual records of the actual production rate shall be <br />maintained and made available to the Division for inspection upon request. <br />2. The applicant shall follow the fugitive dust control plan as submitted with the application. <br />Any changes with respect to the original submittal which would result in an increase in production above 70,000 tons <br />per year automatically nullifies this exemption. Before actually making any such change, you must apply to the Division <br />for a construction permit based on the anticipated change. A permit must be obtained BEFORE implementing the <br />change. <br />In accordance with C.R.S. 25-7-114.1, the Air Pollutant Emission Notice (APEN) associated with this source is valid for <br />a term of five years. The five-year term for this APEN expires on August 1, 2006.
