(the "Act"), as amended, provides that no permit may he issued undeP <br /> Tie-ct until the. Mined Land Peclamation Board (the "Board") re eives a <br /> Financial Warranty (or Warranties) as described in the Act. <br /> WHEREAS, John Schmahl (the " pprator"), <br /> a dba 3atrpanbtwx1c has applied for a permit to co duct a mining <br /> operation known as Unaweep Mine (the "Operation") on certain <br /> lands in Mesa County, Colorado. These lands re described <br /> in the penrit ape ca ion, as amended and supplemented, and are referred to <br /> herein as the "Affected Lands". <br /> WHEREAS, as part of the application for the permit, the Op rator has <br /> agreed to he bound by all requirements of the Act and all appli able .rules and <br /> regulations of the Board, as amended from time to time. <br /> WHEREAS, in its application for the permit, the Operator has agreed with <br /> the Board to provide for reclamation of the Affected Lands that re now, or <br /> may become, sub.iect to the permit, as required by law. <br /> WHF.RFAS, the Board has determined, in accordance with the A t, that the <br /> estimated costs of reclamation of the Affected Lands are those a ounts for the <br /> stated perinds of time as set forth herein.
