R°,:eu George Eaetutive Director Project Manager RGnald w Cottony 143 Union $oulevazd Division Director Suite 600 Natural Resource Trustee Lakewood, CO 80228 RE: Siegrist Construction Company, Amendment to Current Amendment 112 Application, Permit No. M-1982-015; Decision Regarding the Nature of the Information Provided to the Division on June 28, 2006 DeazMs. Villa, On June 22, 2006 the Division afforded the applicant the opportunity to clarify the adequacy review response materials received by the Division on June 12, 2006. The Division received the applicant's response to that June 22, 2006 clarification request letter on June 28, 2006. In that response the applicant provided the following required clarification information: proposed stream bank protection specifications, required cross-sectional diagrams of the proposed stream bank protection components, map detailing the location(s) that stream bank protection will occur, and hydrologic and engineering assumptions. Pursuant to Rule 1.8.1(5), the Division has decided that the proposed changes in the Reclamation Plan aze considered an Amendment to the 112 permit application. The Division considers the proposed installation of riprap along the entire reach of the St. Vrain River to be a substantial enough change to classify it as an Amendment to the 112 permit application. Rule 1.6.6 requires the applicant to publish and mail a new notice of the application. The Division has also included in this package, under separate cover, its Second Adequacy Review of the response submitted to us on June 12, 2006 and subsequent items sent on June 28, 2006. All documents pertaining to this amendment must be placed with the County Clerk and Recorder and the Applicant must provide the Office with an affidavit or receipt that this has been done within 5 working days of placement. Pleasc be advised that Siegrist Construction Company's current Amendment to a 112 Application maybe deemed inadequate, and the application may be denied on September 25, 2006, unless the information requirements listed in the enclosed Second Adequacy Review Letter and the Second Office of Office of Colorado Mined Land Reclamation Active and Inactive Mines Geological Survey
