BLISS PRODUCE CO. <br />2438 E. 8~ ST. <br />P.O.BOX 816 <br />GREELEY, COLORADO 80632 <br />Telephone :970 353 1864 <br />Fax: 970 351 7007 <br />Division of Minerals and Geology <br />The Mineral Land Reclamation Board <br />1313 Sherman St., Room 215 <br />Denver, Co. 80203 ~~~:EO~~® <br />Re: Final Hearing Presentation APR 3 0 2004 <br />Varna Co. <br />Permit # M-78056 Olvlslo~i of Mineris & GenIoAY <br />Durham Pit; Amendment 1 Application <br />Dear Sir: <br />In reference to the above, we object to the amendment due to the possible flooding along <br />the Cache La Poudre river that is adjacent to our property located at 2438 ,2440, 1760 , 2350, <br />2400, 2040, 2030 and 2024 East 8's St. Greeley, Co <br />Varna Company has increased the elevation of the dike on the south side of the Cache <br />La Poudre and appears to be in violation of their original permit issued by the Mineral Land <br />Reclamation Boazd which states the dike shall be no more than 8 to 9 feet above the river bed. <br />This stretch of land extends approximately'/. mile. The build up of this dike could cause serious <br />damage should flooding occur. <br />Also, Varna is in the Floodway and according to the regulations of the City of <br />Greeley, Weld County, FEMA, and Core of Engineers, there shall be no building or <br />raising the elevation of the dikes to obstruct the natural flow of water incase of flood. <br />In order to rectify any violations and avoid future problems, we aze requesting <br />the dikes be lowered to the original height of no more than 8 or 9 feet above the river <br />bed. Enclosed see photos Exhibit #1 through Exhibit #13 with note's. They aze as <br />follows: <br />Exhibits #1 thru #8: Photos displaying the original dike and photos showing fresh dirt <br />being dumped, increasing the height of the dike and landscape. <br />Exbibit #9: Photo displaying the 1983 flood of Anderson Salvage Co. ,located at 1490 <br />E. 8a' St. Greeley, Co. (Property located west of Bliss properties) <br />Exhibit #10: 1983 photo displaying Anderson Salvage Co. (property west of Bliss <br />properties) and the Cache La Poudre, showing the dike on the south side is a lot lower and <br />with spillways. Since 1983 the dike has been built up in the floodwav. (See Exhibit #11) <br />Exhibit #11: Showing the difference from the yeaz 1983 and yeaz 2003, with new build <br />up ofdike on the South Side of the river and spillways eliminated m the floodwav. This <br />was built up under Varra's control. <br />
