<br />of such dispute then Contractor may proceed to terminate the contract in accordance with <br />Article 8.2. <br />3.6 Contractor shall not acquire materials and/or equipment for the performance <br />of the Work under this Agreement except as set forth in Exhibit A. <br />A lr~icle 4 -Contract Documents <br />4.1 The Contract Documents consist of this Agreement and all attached Exhibits, <br />the MOU, the Scope of Work, all Amendments, and all accepted Change Orders. The <br />intent of the Contract Documents is to include all items necessary for the proper execution <br />and completion of the Work. The Contract Documents are complementary, and what is <br />required by any one shall be deemed to be required by all. <br />Article. 5 -Contractor's Representations. Warranties. and Re$ponsibilities <br />5.1 Contractor represents and warrants to BMRI that it has the authority to enter <br />into this Agreement and to perform the Work, and that it is licensed and authorized to <br />practice engineering and/or conduct business in the state where the Work is to be <br />performed.
