The materials
submitted to-date hale nearly satisfied the T 12c permit applicafioti requirements; but there are "
still a.few items,to~r8spond~to.~.Please provide the information that I am requesting on the items
listed below: ,
As you are aware,;tllis office has received commenton this conversion application'from Conejos
County Land •Use- The letter from that office states_ that you Have a conditional use permit for an
expansion of the pit, but only up to a-limit of 19.69 acres. The letter additionally states that if you
seek to expand your permitted operation.up to 65.188 acres, they. will object. (A copy of the
letter is attached with this tettet, for your information,") Have you resolved this situation with
Conejos County Land Use? If not, the Division may have to condition'the approval of the
conversion application such that~the county requirement is met before expanding your disturbance
beyond ] 9.69 acres. `Please comment.'
Given the complicating factors that that we.have not received information from you or the county
demonstrating that this is resolved, and that it could affecYthe conditions attached to our
-- approval,-the decision date for the application h`as been extended'to.allow you to'piovide any--
nece"ssary information. The decision date is reset to October 17, 2007.
For the mining plan, please state what the.depth of the pit will be.
Please state what depth of topsoil will be stripped prior to excavation. A range of depths, rather
than a specific depth figure is acceptable.
Where wiU the topsoil be stored before it is to be replaced?
The file materials give a variety of final slope gradients, from 2:1 to 10:1. Please state what the
maximum slope gradient will be.
The map does not clearly show how close the edge of the pit wilt be to the permit boundary.
How close will the pit be to the boundary (assumed to be the fenceline)? Please be reminded that
if Topsoil is stockpiled along the fence, adequate space must be left between the fence and the
Office of Office of
Mined Land Redama[ion Active and Inactive Mines
