I apologize for hitting you with all this Henderson stuff at once; I had tried to call <br />you earlier in the month, but learned you were out until today, so I'm sure you have plenty to do. However, we have <br />scheduled apre-hearing on the Henderson mined land reclamation permit amendment for Tuesday, May 20 at 1:30 in <br />the commissioner's meeting room at the Grand County Courthouse. Included with this fax is explanatory information <br />that we send to parties prior to pre-hearing conferences. As you know, Henderson has made changes to the <br />amendment in response to comments from the Forest Service and Grand County. Tomorrow, I will fax you the <br />Division of Minerals and Geology summary of the status of the Henderson Amendment Application to describe what <br />will be required of Henderson if the amendment is adopted, particularly as it relates to tree and shrub planting and the <br />potential future consideration of a wet cover for tailing impoundment reclamation. I think the summary will assist all <br />parties in knowing just what approval of the amendment as it now stands will do and will not do in terms of mined <br />land reclamation requirements. If the Forest Service is satisfied with the current version of the amendment, and will <br />withdraw the Forest Service objections in writing, you do not have to attend the pre-hearing conference. <br />If it is decided to proceed to a hearing before the Mined Land Reclamation Board, all parties are entitled to a 30-day <br />notice of the hearing.
