amended, and Section 8.3, for designated chemicals used on site, and appropriatelneasures recommended by <br />the Colorado Division of Wildlife (DOW) for the protection of wildlife from damage from designated <br />chemicals, toxic or acid-forming materials and acid mine drainage. <br />(a) An Environmental Protection Plan is not required to address proposed or permitted activities <br />that do not involve, affect, or influence the storage, handling, or disposal of the designated chemicals and that <br />do not disturb toxic or acid-forming materials, and that do not cause, or have the potential to cause, generation <br />of acid mine drainage. <br />(b) Tn order to protect the public and the environment from the adverse effects of designated <br />chemicals, acid or toxic producing materials or acid mine drainage, the Board may consider whether there is a <br />potential for adverse impacts. <br />(c) Such a detemilnation will evaluate, specifically, the potential for <br />adverse impacts from any: <br />(i) leach facilities, or heap leach pad; <br />(ii) tailings storage or disposal areas; <br />(iii) impoundments; <br />(iv) waste rock piles; <br />(v) stock piles, temporary or permanent; or <br />(vi) land application sites. <br />(d) The Board shall consider economic reasonableness and technical feasibility when determining <br />whether the proposed location adequately assures compliance with performance standards of the Act, or may <br />require that an alternate location be evaluated. <br />(e) The Board shall also consider current or pre-existing conditions and the degree to which the <br />proposed plan would provide for net improvements in the protection of human health, property or the <br />environment. <br />(2) Maps - An Environmental Protection Plan shall identify on map(s), sketch(es), plan(s) or other <br />equivalent representations, the locations where designated chemicals, toxic or acid-forming materials, which <br />will be used, stored, handled, exposed, disturbed or disposed of within the permit area, and existing or <br />potential sources of acid mine drainage. The locations shall be shown in accurate relationship to topography <br />and other project facilities within the permit ayes. The Operator/Applicant may submit this information <br />as a map accompanying this Exhibit or include the information on the maps required as Exhibit C in this <br />Subsection, 6.4.3. <br />(3) Identification of other agencies' environmental protection measures and monitoring -identify which <br />environmental protection measures and monitoring are required by statute, regulation or permit by other <br />agencies or jumisdictions. <br />(4) Other Permits and Licenses -The Environmental Protection Plan shall: <br />(a) list any air, water quality, solid and hazardous waste, and other federal, state permits <br />or local licenses, or other formal authorizations which the Operator/Applicant holds or will be seeking <br />
