COOLEY RESERVOIR AND FULTON WILDLIFE AREA PIT <br />A~4ENDMENT NO. 1 - JERONIMUS PROPERTY <br />(Revised 05/03) <br />5. No mining shall occur within 65 of the inside top east high bank of the Fulton Ditch without <br />approval by the DMG of an Agreement with the Fulton Irrigating Ditch Company. <br />No mining shall occur within 200' of the South Adams Water and Sanitation District sewer <br />line without approval by the DMG of an Agreement with the South Adams Water and <br />Sanitation District. <br />No mining shall occur within 200' of the property to the east and north of the Xcel right-of- <br />way (Topper) without approval by the DMG of an Agreement with this property owner. <br />8. No mining shall occur within 200' of property to the east and south of the Xcel right-of--way <br />(Gibson} without approval by the DMG of a Slope Stability Analysis for a lesser setback. <br />Prior to installation of the conveyor and pipe crossing across the Fulton Ditch, an Agreement <br />acceptable to the DMG with the Fulton Irrigating Ditch Company will be obtained. <br />10. No partial dewatering shall be undertaken without an Agreement with shallow we]] owners <br />within 600', or the State Engineer's Office (SEO) approves partial dewatering. <br />11. No muting shall occur within 2' of the groundwater table in any area not already exposed to <br />the surface until the State Engineer's Office (SEO) approves a substitute water supply plan <br />or another plan that allows such exposure of"groundwater. <br />12. Prior to any disturbance being undertaken, proof of amendment to existing SWMP Permit, <br />or the obtaining of new S WMP Permit shall be submitted to the DMG. <br />13. Prior to any disturbance being undertaken, a revised Spill Prevention Control Plan with the <br />addition of the below language shall be submitted to the DMG. <br />"A reportable spill is a spill of any toxic or hazardous substance (including spills of petroleum <br />products) within the permit area reportable to any Division of the Colorado Department of <br />Health and the Environment, the National Response Center, the Colorado Emergency <br />Plarning Commission, a local Emergency Planning Commission , or the-State Oil Inspector. <br />The operator shall notify the Office of a reportable spill within the permit area using the same <br />time frame required by the pertnit, license, notice, Act, Rule, or Regulation governing the <br />reporting of the spill to the appropriate agency. Notice of a reportable spill shall be Faxed to: <br />Minerals Program Supervisor, Division of Minerals and Geology, FAX (303) 832-8106. The <br />FAX shall include acall-back number of a responsible company official for the DMG staff to <br />use as a contact." <br />
