The parties conc~.:r that this matter shall be <br />dismissed with prejudice and that each side shall bear its own <br />attorneys' fees and costs. <br />3. C.R.C.P. 41(a)(1)(B) in pertinent part states: <br />Voluntarily diemiaeal; Effect thereof. <br />...by stipulation. ...An action may be <br />dismissed... (B) by filing a stipulation <br />of dismissal signed by all parties who <br />have appeared in the action or by their <br />attorneys... <br />4. Contemporaneously with the filing of this Stipulated <br />Motion to Dismiss, the parties are filing a similar Motion to <br />Dismiss with.
