The following responses have been organized in the same format as Ms. Katlileen Sullivan's
Adequacy Review letter dated August 25, 2005 to Rob Laird, Asphalt Specialties Co., Inc.
(ASCI). Changes to specific Exhibits are noted in the responses and all changes to the application
have been enclosed and filed with the Weld County Clerk and Recorder's Office.
1. Proof of publication was sent to Ms. Suzi Erickson via memo on August 19, 2005. A
copy of that proof, along with the memo, is enclosed. Proof of Notice to all surface
owners within 200 ft of the affected land, structure owners and easement holders was sent
to the DMG on October 12, 2005 by Weiland, Inc. and should be contained within the
case file for this permit amendment.
6.4.3 Exhibit C -Pre-Minine and Mining Plan Map(s) of Affected Lands
Exhibit C-1 is the Pre-Mine Plan Map. This map was not re-submitted with the
amendment, AM-I, as no changes to the original map were warranted. Surrounding
landowners within 200 ft of the affected Land have not changed as of the date of the
application submittal and are shown on Exhibit C-1. They remain the same as of the date
of this letter as well. The intent of the original application/permit area (M-2004-009) was
to permit the entire property under control by ASCI, intending to amend the permit (AM-
1) at alater date for mining in the south %tof the permit area. Structures within 200 ft aze
shown on Exhibit C-2 and all owners of structures within 200 ft of the affected land have
been listed on Exhibit C-2, which is enclosed.
2. The pit boundary on the Mining Plan Map, Exhibit C-2, has been updated to match the
reclamation plan boundary on Exhibit F.
3. Typical overburden stockpile locations have been shown on Exhibit C-2, the Mining Plan
Map.
4. Exhibit C-2 has been edited to include labels for the Plumb and Dailey Ditch, major
roadways, and the southeast and northwest corners of Section 31.
5. The dischazge pipes have been tied-in to dewatering trenches for each mining Cell within
100 feet of Boulder Creek. These discharge pipes are located at the lowest elevation of
each mining Cetl in relation to the distance from Boulder Creek and will be used in
conjunction with a dewatering pump to dischazge alluvial groundwater ("mine
