Following aze a few <br />items that need to be addressed in order to meet the minimum requirements of the Act/Rules and <br />Regulations: <br />1. Exhibit C -pursuant to requirements of Rule 6.2.1(2)(e) the maps and exhibits should be <br />no smaller than 1"=660 feet. The maps you submitted aze 1"= 1320 feet. Please redo the <br />maps in exhibit C and exhibit F to comply with Rule 6.2.1 and submit 2 copies. <br />2. Exhibit D -counting the new access road, the disturbed area north of the weigh scales, the <br />weigh scale azea, the new refueling azea and the area being mined, it appeazs there aze, or <br />will be, more than 40-acres of disturbance. In the original permit application a phased <br />mining plan was approved. Each phase was to contain 40-acres. The existing access roads <br />were not included in the affected land azea (phased azea) since they were not significantly <br />improved. Does the operator intend to increase the size of the phased areas? If the <br />landowner wants the new road to remain as is when mining ceases you will need to <br />submit a signed and notarized document from the landowner stating that he wants the road <br />left. <br />In order fo identify the sequence of mining operations in the future (after the initial 6 <br />phases have been mined) the operator will need to submit a technical revision outlining <br />the various phased areas (7 thru ?). <br />Confirm that the operator will install a weigh scale and a refueling station, and the <br />location of each structure. Also, provide the Division with specific information regazding <br />the spill control structure (size, clay lined or geomembrane lined, etc) and the capacity of <br />the constructed containment facility for the fuel tank as approved in the SPCC permit. <br />3. Exhibit F - see pazagraph 1 above regazding map scale requirement and copies. <br />Please show the expected physical appeazance of the entire proposed affected azea on the <br />Reclamation Plan map. The exhibit map you submitted only shows contour lines for the <br />currently permitted 240-acre affected land area. <br />4.
